Privacy Policy

I. General Principles

This Privacy Policy (“Policy”) describes how the Branch of My My Trading – Service Co., Ltd. - American International Hospital (“AIH” or “we”) collects, receives, aggregates, stores, uses, processes, discloses, shares, and ensures the security of Customer Information of organizations and individuals (“Customer” or “you”), including customers, agents, suppliers, contractors, and partners who: (i) use services provided directly at AIH’s medical examination and treatment facilities; (ii) access or use customer interaction channels owned by AIH, including but not limited to the website www.aih.com.vn, the AIH application, websites, and groups on social media platforms (such as Facebook, etc.) owned by AIH (“AIH Channels”) (items (i) and (ii) hereinafter collectively referred to as “Services”).

“Customer Information” refers to any information or data that can be used to identify a Customer or based on which a Customer can be identified, such as name, nationality, phone number, payment and banking details, personal preferences, email address, location, images, ID card/citizen identification information, date of birth, marital status, insurance information, transaction information, access history, customer journey, biometric data, and medical/health records.

By accessing or using the Services, Customers acknowledge that they have read, understood, and agreed to the contents of this Privacy Policy. AIH may, at any time, amend, supplement, or update this Privacy Policy. Any amended, supplemented, or updated Privacy Policy will be posted on the website www.aih.com.vn. Continued use or access to AIH Channels or Services by Customers shall be deemed as their agreement to the amended, supplemented, or updated Privacy Policy.

This Privacy Policy is provided in both Vietnamese and English. In case of any discrepancy between the Vietnamese and English versions, the Vietnamese version shall prevail.

II. Customer Information We Collect

We collect Customer Information during the process of providing Services to you.

The types of information we collect are as follows:

1. Information Provided by Customers

a) We collect any information you provide in connection with the Services during activities such as: (i) using the Services or participating in scientific research projects or clinical trials conducted by AIH; (ii) registering or logging into accounts, interacting with AIH Channels; (iii) participating in seminars, customer events, contests, games, surveys, or other events organized by AIH; (iv) using biometric functions for personal identification or transaction verification.

b) Customers are responsible for ensuring that the information they provide is complete, accurate, and up-to-date to safeguard their rights under the terms of the respective Service. AIH shall not be responsible if Customers provide inaccurate or incomplete information as required by the Service.

c) For Customers under 18 years of age, please ensure that you have obtained full consent and approval from your parents or legal representatives for providing Customer Information to AIH. Parents or legal representatives will be bound by this Privacy Policy and responsible for the Customer’s actions. AIH reserves the right to refuse access to AIH Channels or provide related Services if there is evidence that a Customer under 18 has not obtained such consent or approval from their parents or legal representatives.

d) If Customers provide information about any third party, they represent and warrant that they have obtained full consent and approval from that third party for providing such information to AIH and for AIH’s use of that information in accordance with this Privacy Policy. AIH shall not be liable to any third party if Customers provide information without their consent or approval. In such cases, Customers shall bear all responsibilities arising from providing such information, including resolving, at their own expense, any complaints or lawsuits from third parties against the Customer and/or AIH, and reimbursing AIH for any amounts paid to third parties, if any, related to such complaints or lawsuits.

2. Automatically Collected Information: We automatically collect certain types of information when you interact with the Services.

AIH may collect information and data related to activities Customers perform within the scope of the Services, including but not limited to information about service or product providers, transaction details (e.g., type of goods or services, location, and time of transactions), payment methods (excluding critical payment card details such as full card numbers, CVV, or other legally equivalent authentication codes), device information (e.g., IP address, operating system, browser type, hardware specifications, UDID, MEIDs, location, referring website address (if any), pages visited on AIH Channels and mobile applications, number of visits, responses, file names, versions, advertising identifiers, and other related information, if applicable).

3. Collection and Use of Cookies

a) We use cookies, pixels, and similar technologies (collectively referred to as “cookies”) to identify your browser or device, learn more about your preferences, provide essential features and services, and for additional purposes, including:

b) Identifying you when you log in to use our Services, enabling us to provide recommendations, display personalized content, and offer tailored features and services.

c) Respecting your preferences, such as language and configuration settings.

d) Conducting research and analysis to improve our Services.

e) Preventing fraudulent activities.

If you disable all cookies, neither we nor third parties can transfer cookies to your browser. III. How We Protect Customer Information

At AIH, security is our top priority. Our systems are designed with a focus on ensuring the safety and privacy of your information. All Customer Information is stored and secured by AIH’s systems or by service providers acting on behalf of AIH in accordance with applicable laws and this Privacy Policy.

When collecting data, AIH makes every effort within permissible limits to store and secure Customer Information on our servers, protected by firewalls, access control measures, and data encryption. AIH implements appropriate technical and security measures to prevent unauthorized access or use of Customer Information to the fullest extent possible. We also regularly collaborate with security experts to stay updated on the latest cybersecurity information to ensure the safety of Customer Information.

Payment card information issued by financial institutions is protected according to international standards, and we do not store critical payment card data (e.g., full card numbers, cardholder names, CVV, or other legally equivalent authentication codes) on our systems. Your payment transactions are processed through the systems of relevant banks or affiliated service providers via AIH Channels.

Customers must not use any tools, programs, or measures to illegally interfere with or alter the data structure of any Service or engage in any activities aimed at distributing or promoting actions to interfere with, sabotage, or infiltrate AIH’s system data or violate Vietnamese law. If we detect any such violations, we reserve the right to share information about the violation with competent authorities for legal action.

You are responsible for protecting your account information and must not share any account-related details, passwords, or authentication methods (e.g., OTP) for accessing websites, applications, software, or other tools (if applicable).

We store Customer Information to ensure your continuous use of the Services and retain it for the duration necessary to fulfill the Purposes, comply with legal requirements (including tax and accounting purposes), or perform other tasks as previously notified to you. The specific retention period varies depending on the Purpose. When Customer Information is no longer necessary for providing Services or fulfilling Purposes, or when AIH no longer has a business or legal basis to retain it, we will take steps to prevent access or use of the information for any purpose other than compliance with this Privacy Policy, or for safety, security, fraud detection, and prevention purposes, or we will anonymize identifiable information in accordance with applicable laws.

Customer Information may be stored, accessed, or transferred to multiple countries, including Vietnam. When transferring Customer Information to other countries, we ensure compliance with this Privacy Policy and applicable laws and regulations.

IV. How We Use Customer Information

We use Customer Information to operate, provide, and improve the Services for the following purposes (“Purposes”):

1. Providing Services: We use Customer Information to:

a) Provide Services and process related transactions, including registration and payments;

b) Recommend Services you may be interested in, identify your preferences, and personalize your experience with the Services;

c) Perform internal operations necessary to provide Services, including troubleshooting software errors and operational issues, conducting data analysis, testing, research, monitoring, and analyzing usage trends and activities;

d) Protect the confidentiality or integrity of the Services and any facilities or devices used to provide them;

e) Verify transactions and process payments;

f) Create, manage, and update Customer accounts and verify Customer identities;

g) Facilitate interactions between Customers and AIH or between Users and affiliated partners (if any).

2. Measuring, Supporting, and Improving Services: We use Customer Information to measure usage, analyze performance, fix errors, provide support, improve, and develop the Services.

3. Complying with Legal Obligations: We are legally obligated to collect, use, or store Customer Information in certain cases, including when required, advised, requested, or demanded by legal advisors, applicable laws, regulations, government or competent authority requests, including but not limited to obligations for disclosure, reporting under promotional regulations, record retention, auditing, investigations, dispute resolution, compliance with court orders, legal requirements, government requests, or other agreements, and to protect our rights or property in case of complaints or disputes.

4. Communicating with You: We use Customer Information to communicate with you regarding the Services through various channels (e.g., email, chat) and to respond to your requests.

5. Marketing: We use Customer Information to market and promote the Services. We may display advertisements for Services based on your preferences.

6. Fraud and Abuse Prevention, Asset and Credit Risk Management: We use Customer Information to prevent and detect fraud and abuse to protect the security of our Customers, ourselves, and others. We may also use scoring methods to assess and manage asset and credit risks.

7. Specific Purposes Requiring Your Consent: We may seek your consent to use Customer Information for specific purposes when we contact you.

V. How We Share Customer Information

Customer Information is an essential part of our operations, and we do not sell it to others. We only share Customer Information as described below and within the limits permitted by law. Third parties receiving Customer Information in accordance with this Privacy Policy must comply with this Policy, similar policies, and relevant legal regulations.

Compliance with Competent Authorities or Legal Requirements: We may share information as required by competent authorities or applicable laws.

Third-Party Transactions: We provide services, software, and content from third parties for use on or through the Services. You will be informed when a third party is involved in your transactions, and we will share relevant transaction information with that third party.

Third-Party Service Providers: We engage other companies and individuals to perform tasks on our behalf, such as sending communications, processing payments, assessing credit and compliance risks, analyzing data, providing marketing and sales support (including advertising and event management), managing customer relationships, and training. These third-party service providers have access to the Customer Information necessary to perform their functions but are prohibited from using it for other purposes. They must also comply with this Privacy Policy and applicable privacy protection laws.

Business Restructuring or Transfer: As part of business development, we may sell, purchase, or restructure businesses or services in accordance with applicable laws. In such transactions, Customer Information, databases, and usage rights are typically among the transferred business assets but remain subject to this Privacy Policy (or as approved by Customers). If AIH or a substantial portion of its assets is acquired by another company, your information will be among the transferred assets.

Protecting Us and Others: We may disclose account and other Customer Information when we believe it is appropriate to comply with the law, enforce or apply our terms and agreements, or protect our rights, property, or safety, or that of our Customers or others. This may include sharing information with other companies and organizations to prevent fraud and reduce credit risks.

Based on Your Choices: Beyond the cases above, you will be notified when your Customer Information may be shared with third parties and given the option to consent to such sharing.

Sharing Without Consent: In accordance with applicable laws, medical information about you may be shared, as decided by the person in charge of the medical facility, to improve diagnosis, care, and treatment quality among healthcare professionals directly treating you, or with certain individuals accessing records, such as interns, researchers, or healthcare professionals borrowing records on-site for reading or copying for research or professional purposes, or as required by competent Vietnamese authorities.

VI. Access and Choices

Unless otherwise required by law, you may view, update, or delete certain information about your account and interactions with the Services. If you cannot access or update your information yourself, you can always contact us for assistance.

You have several choices regarding the collection and use of Customer Information. Many Services include features allowing you to customize how your information is used. You may choose not to provide certain information, but this may limit your ability to use some Services.

a) Account Information: To add, update, or delete information related to your account, please email mailto:info@aih.com.vnand follow AIH’s instructions. When you update or delete information, we typically retain a copy of the previous version for technical purposes.

To stop receiving in-app notifications, adjust the notification settings in the app or on your device.

c) Advertising: If you do not wish to see interest-based advertisements, please email mailto:info@aih.com.vnand follow AIH’s instructions.

d) Browser and Device: The ‘Help’ feature on most browsers and devices will guide you on preventing your browser or device from accepting new cookies, notifying you of new cookies, or disabling cookies entirely.

VII. Communication, Notices, and Amendments

Our business is constantly evolving, and this Privacy Policy may be amended accordingly. You should regularly visit our website to check for recent changes. Unless otherwise stated, the current Privacy Policy applies to all Customer Information we hold about you and your account.

VIII. Additional Information for Europe

We provide additional information regarding privacy, the collection, and use of Customer Information for prospective and current Customers in European Union countries.

1.  Data Controller: The Branch of My My Trading – Service Co., Ltd. - American International Hospital (located at No. 6, Bac Nam 3 Street, An Phu Ward, Thu Duc City, Ho Chi Minh City, Vietnam) is the data controller for Customer Information collected or processed under this Privacy Policy.

2. Processing. We process Customer Information based on one or more of the following legal bases:

a) Necessary to enter into a contract with you or the organization you represent, fulfill contractual obligations, provide Services, respond to your requests, or provide customer support;

b) When we have a legitimate interest, as described in Section II of this Privacy Policy;

c) Necessary to comply with legal and regulatory obligations;

d) To respond to lawful requests; or

e) Based on your consent.

3. Your Rights. Under applicable laws, you have the following rights:

a) To inquire whether we hold Customer Information about you and request copies of such information and details about how it is processed;

b) To request correction of inaccurate Customer Information;

c) To request deletion of Customer Information no longer necessary for processing purposes, processed based on consent that has been withdrawn, or processed in violation of applicable laws;

d) To request suspension of processing Customer Information if the processing is inappropriate;

e) To object to the processing of personal data;

f) To request the transfer of Customer Information you provided to us (excluding information derived from collected data) where processing is based on consent or a contract and is carried out by automated means; and

g) To lodge a complaint with a competent authority if you believe we are violating your privacy rights.

You may exercise your rights to access, correct, delete, suspend, object, or transfer information by contacting us. If you are our Customer and wish to exercise any of these rights, please contact us. If you are not our Customer, please contact us as indicated in Section V above.

When you consent to our processing of your Customer Information for a specific purpose, you may withdraw that consent at any time, and we will cease processing your data for that purpose.

4. Transfer of Information Outside the European Union. When transferring Customer Information collected and stored in the European Union to countries outside the EU, we will comply with this Privacy Policy and applicable privacy protection laws. This may include transferring data under data transfer agreements incorporating Standard Contractual Clauses approved by the European Commission.
